Terms of Sale

OrderOnlineDrugs.com is a prescription drug service pharmacy that specializes in the delivery of online and mail-order pharmaceuticals, licensed by the College of Pharmacists of British Columbia: License #J30. The terms and conditions listed below regulate all sales between OrderOnlineDrugs.com (hereby known as the “Pharmacy”) and the customer (the “patient”) concerning all products and services (the “Products) presented for sale by the Pharmacy. By accepting the delivery of Products expressed on a purchase order (an “Order”), the Customer agrees to adhere to and accept the Terms of Sale.

1. Medical Examination. The Customer has personally attended a physical examination by a licensed practitioner (the “Prescribing Practitioner”) and received a prescription form within the last 12 months that will not necessitate any further physical examination.
2. Original Prescription Compulsory. The Pharmacy will not recognize or accept any Order unless the Patient sends the Prescribing Practitioner’s original prescription or unless the pharmacy receives the original prescription from the Prescribing Practitioner by facsimile.
3. Power of Attorney. The Customer shall consent to appointing the Pharmacy as its attorney and agent, to take all steps, sign all documents and to operate on its behalf as if the Customer were personally present and representing itself for the limited purposes of (a) obtaining a valid and legal prescription for any prescription which the Customer had sent to the pharmacy; and (b) packaging the Customer’s Order and sending it to the Customer. The Customer’s permission will include, but not be restricted to, the collection of personal and personal health information and the disclosure of this information to the Pharmacy, the physician and any other health professionals being engaged for the Customer, as required. The Customer’s permission may be retracted at any time and shall be continued until the Customer retracts it.
4. Orders, Prices and Payment Terms. Orders are not fixed upon OrderOnlineDrugs.com until formally accepted in writing. The prices for the Products will remain as specified by the Pharmacy and as expressed on the website as at the time of approval of an order. Prices for Products will be subject to change without further notice. Payment for an Order may be made by a credit card accepted by the pharmacy, bank draft, personal cheque or money order.
5. Shipping Fees and Taxes. In a number of cases, additional charges for shipping and handling will be shown on the invoice(s). The Customer is accountable for services tax, sales and all other taxes connected with the Order, however selected, as required in Canada. If applicable, a separate charge for taxes will be noted on the OrderOnlineDrugs.com invoice.
6. Shipping. Delivery of the Product to the Customer will take place when the product leaves the Pharmacy. After delivery, the Pharmacy will, as attorney and agent for the Customer, organize all shipping methods necessary to reach the Customer’s home address. In most cases, the Customer’s product shipment takes fourteen to twenty-one days to arrive. If the Customer’s shipment is significantly delayed, and upon notice from the Customer, OrderOnlineDrugs.com will organize with the Pharmacy to replace the overdue shipment, and the Pharmacy will re-deliver and re-ship the product to the Customer at no additional cost. OrderOnlineDrugs.com is not responsible for any harm to the Customer due to delay in delivery or failure of the product to arrive within 21 days.
7. Warranties. THE MANUFACTURER OF EACH PRODUCT IS EXCLUSIVELY RESPONSIBLE FOR ANY WARRANTY ASSOCIATED WITH A PRODUCT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORDERONLINEDRUGS.COM DISCLAIMS ANY WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, IN RESPECT OF THE PRODUCTS AND SERVICES CONTEMPLATED BY THESE TERMS OF SALE, INCLUDING, WITHOUT LIMITATIONS, IMPLIED WARRANTIES AND CONDITIONS OF MECHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. RESPONSIBILITY FOR CLAIMS IN RESPECT OF THE PRODUCTS IS LIMITED TO REPLACEMENT OF THE PRODUCT.
8. Privacy Policy. The Customer will fully and accurately divulge their personal information and approve of its use by the pharmacy. By placing an Order with OrderOnlineDrugs.com, the Customer consents to the gathering and use of personal information as described in our Privacy Policy. OrderOnlineDrugs.com reserves the right to amend its Privacy Policy once in a while by announcing the updated policy on its website. The Customer agrees to review the Privacy Policy every time it submits an Order.
9. Return Policy. OrderOnlineDrugs.com reserves the right to amend its Return Policy once in awhile by announcing the updated policy on its website. The Customer agrees to review the Recall Policy each time it submits an Order.
10. Recall Policy. During the first 24 hours after receiving an announcement of a recall notice from a manufacturer or supplier, OrderOnlineDrugs.com will:
    • Verify if any current inventory is affected by the recall;
    • Verify purchase orders from the last three months or within the time frame noted on the recall notice to establish if OrderOnlineDrugs.com previously had the product that has now been recalled;
    • Verify outstanding purchase orders in transport to confirm that the lot numbers and expiry dates are for non-recalled product only.
    In the case that OrderOnlineDrugs.com has any recalled product, it will immediately get rid of the recalled product from inventory, place it in a chosen and plainly marked “quarantine” area and will arrange to return the recalled product to the manufacturer or supplier.
    
    If you have received a product that has been recalled, OrderOnlineDrugs.com will supply you with all information on how to return the recalled product and will also provide counselling associated with any medication related issues. After being informed of the recalled product from the manufacturer or Health Canada OrderOnlineDrugs.com will prepare a list of patients who may have received the recalled product. OrderOnlineDrugs.com will get in touch with each patient by telephone to alert the patient of that product recall. Several attempts to get in touch with the patient by telephone will occur. If there is no answer, a message will be left for the patient to contact OrderOnlineDrugs.com. OrderOnlineDrugs.com will also mail the patient a warning of the product recall.
11. Product and Service Offerings. OrderOnlineDrugs.com may revise and discontinue the Products and Services displayed on the website at any time without previous notice.
12. Export Restrictions. It is important to understand that not every one of OrderOnlineDrugs.com’s services displayed on the website are available in all provinces in Canada or in jurisdictions outside of Canada. The Food and Drug Administration has decided that nearly all shipments of prescription drugs brought in from an international pharmacy by a United States customer will breach United States law. By placing an Order for product or services, the Customer symbolizes to OrderOnlineDrugs.com that transaction, delivery and shipment of the Products will not breach any import, export or other law or regulation in the Customer's home jurisdiction.
13. Entire Agreement. The Customer agrees that these Terms of Sale and any document incorporated by indication or referred to herein comprise the complete agreement between the Customer and the Pharmacy applying to the subject-matter of these Terms of Sale, and surpasses, terminates and otherwise renders null and void any and all prior agreements, understandings, negotiations, contracts, proposals or requests for proposals, whether written or oral, between the Customer and the Pharmacy. In the occurrence of a disagreement between these Terms of Sale and any of the documents incorporated by indication or referred to herein, these Terms of Sale shall rule.
14. Severability. The invalidity or unenforceability of any condition of these Terms of Sale shall not change the validity or enforceability of any other condition hereof and any such invalid or unenforceable provision shall be judged to be severable.
15. Headings. Each section heading used herein are for ease of reference only and do not outline a part of these Terms of Sale, and no construction or inference shall be derived therefrom.
16. Force Majeure. OrderOnlineDrugs.com will not be held responsible for any delay or failure in performance caused by conditions outside of its control, including, without limitation, delays due to backorders of requested products, mail delays, customs delays, lost shipments. OrderOnlineDrugs.com will not be accountable to inform the Customer in the occasion of such delays. The Customer shall be exclusively accountable to make other measures to obtain substitute products and any expenses incurred with such purchases.
